My name is Jessica de Roos. I specialise in and am an expert in land matters (e.g. expropriation, tolerance obligations, land sales, agricultural tenancy, the Didam judgment, inappropriate land use). I mainly assist water boards and other public authorities in large-scale projects. A few examples:

 

I advise water boards on their property policies and third-party use of their land.

 

I also make sure they make land available in good time to enable measures and regulations such as the High Water Protection Programme and the Water Framework Directive to be implemented.

 

Provincial authorities and municipalities know where to find me to assist with the implementation of local and regional projects.

 

I ensure that land is made available to public authorities in good time with realistic compensation, based on solid agreements regarding the use of the land. For instance, I advise on acquisition strategies, the choice of instrument to be used (expropriation or the obligation to tolerate) and compensation levels.

 

Another important part of my practice involves advising and litigating on the opportunities and limitations that the Didam judgment entails for the allocation of land by public authorities.

 

Agricultural tenancy and long-term leases demand my particular attention, and I advise and litigate for both lessors and lessees.

 

I have worked intensively with many of my clients for several years.

 

I am pragmatic, I share ideas and my analyses are incisive. I am also practical and focused. I do not shy aware from litigation, but I prefer to arrive at a quick, good and practical solution in consultation with all parties involved. My clients and their consultants come back to me because they can rely on me and I like taking the work out of their hands.

 

I very much enjoy giving courses, webinars and workshops and I do so frequently. I also contribute to professional journals including the Tijdschrift voor Agrarisch Recht (the journal for agricultural law) and the Tijdschrift voor Bouwrecht (the building law journal) for both Kluwer’s De Groene Serie (the green series) and the Staatsdrukkerij (the Government Printing Office (Sdu).
