Support with implementation and disputes
The legal issues within the social domain are diverse. We assist healthcare providers and local authorities with healthcare procurement, including discussions on (fair) rates, the content of the Schedule of Requirements and the Summary of Additional Information and Changes, or issues relating to procurement law. We also support partnerships within the social domain.
In addition, we provide legal support to healthcare providers and municipalities on issues relating to the performance of agreements. Think of compliance with contractual agreements, investigations into quality or lawfulness, improvement programmes, the recovery of healthcare funds, and the termination of agreements. Municipalities are regularly confronted with suspected cases of healthcare fraud, which can lead to proceedings under administrative or civil law.
In short, we provide advice and conduct proceedings in areas including:
- Issues of procurement law in the social domain, including realistic rates;
- Administrative proceedings concerning provisions to residents in complex cases or cases with political or media implications;
- Municipal regulations based on, amongst other things, the Youth Act and the Social Support Act 2015;
- Contractual disputes between municipalities and healthcare providers arising from their agreements, including the recovery of healthcare funds;
- GDPR issues in the social domain;
- Case studies at the intersection of healthcare and safety;
- Complaints and disciplinary procedures, including those handled by the Youth Quality Register SKJ;
- Extensive support under the Procedure on Allowances (Miscellaneous Provisions) Act.
