Energy law

The energy transition presents organisations with difficult choices and brings great challenges. Grid congestion, changing connection and transmission charges and new rules for electricity, gas and heat may delay your plans considerably, but we are here to help energy and heat companies, property developers, municipal authorities and other institutions to make headway nevertheless. Whether the production capacity is to be expanded or a heat network is to be installed, we provide feasible solutions that stand up to legal scrutiny.

“The energy transition requires companies to make choices that are both legally sound and practical. We help you capitalise on opportunities, limit risks and move forward with your projects.”

Legal support in the energy and heat transition

Our lawyers have extensive experience with the legal issues arising from the energy transition. We focus on the themes that companies, government authorities and institutions come across in their operations every day, such as the consequences of the Dutch Energy Act and the Dutch Collective Heating Supply Act, the legal structure of energy hubs, contracts intended to reduce grid congestion, and the development of heat networks. We have assisted clients in the incorporation and financing of heat companies, in creating plans to expand production capacity despite limited grid capacity and in drafting collaboration agreements between municipal authorities and market parties, and we now use this experience to translate complex regulations into workable solutions tailored to your everyday activities.

Our expertise

We help organisations make progress in the energy transition by turning complex rules into clear contracts and simple processes. With timely preparations and a carefully thought-out strategy, we advise companies, government authorities and other institutions on the drastic changes that come with the energy transition. Our advice and assistance includes:

  • Energy Act (2026) – replaces the Electricity Act and Gas Act and lays the foundations for the energy transition. We help you get a full grasp of the legal consequences and adapt your contracts and projects to the new Act;
  • Grid congestion & Code Decision (Gotork) – regulates active contract and capacity management in the event of shortages and changed transmission charges. We assess your position and ensure that essential capacity is retained;
  • Energy hubs – we help you set up the legal structure of partnerships involving the generation, storage and use of energy, including governance, liability and permits;
  • Efficiency & renewable (EED / RED III) – regulates compliance with energy-saving obligations and the use of acceleration areas for renewable energy projects. We help you implement this;
  • Heat law (Collective Heating Supply Act & Heat Transition (Municipal Instruments) Act/Decree) – assisting municipal authorities in developing policies and designation orders, and supporting heat companies in obtaining financing, in concessions and in converting existing grids.

Whether you are dealing with contracts, permits, governance or disputes, we ensure that your choices are legally watertight and can be applied in practice, giving you the confidence to start investing or to make more investments in renewable energy and heat.

Examples from practice

  • Production needs to be expanded, but no capacity is available: review of the transmission application, strategic options (temporary flexibility, curtailment, congestion management, redispatch), objection to/appeal against rejection or limitation, and renegotiation of connection and transmission agreements;
  • New production location in an industrial park: location and permit strategy, land allocation and structures, grid connection, energy and heat demand, subsidies and schedule for acceleration areas (RED III);
  • Heat grid in the region: choice between a public/private role, financing mix, procurement and installation, tariff and supply conditions, arrangements with building owners and residents, and integration into the municipal heat programme.
