Real estate law

The real estate sector is in a constant state of flux. Residential construction and area development are under pressure due to spatial scarcity, environmental regulations and changing legislation, while redevelopment, transformation and land issuance increasingly call for tailored strategies. Meanwhile, issues of ownership, financing, partnerships and public‑law procedures play a growing role in every project. Our lawyers and civil‑law notaries guide you through the full lifecycle of your real estate project—from concept and land allocation to construction, operation and final delivery.

“We pair strong legal craftsmanship with a pragmatic approach, focused on solutions that work in the real world.”

Our services

Within real estate law, we advise on both private-law and public-law matters. Our clients include businesses, public and semi-public bodies and healthcare institutions. We combine legal expertise with expertise on the sector and the dynamics in which you operate.

Transactions and land allocation

We assist with the acquisition and sale of real estate and land, the granting of long‑lease rights and other proprietary rights. We also advise on matters covered by the Didam judgment, plot allocation and the legal design of selection procedures. Financing arrangements and security rights also form an integral part of our advisory work. We guide the entire process: our specialists draft agreements, conduct negotiations and ensure that transactions are completed in a legally sound and efficient manner. Where required, we involve our specialised real estate notarial team for notarial execution and transfer.

Development and redevelopment

In area and project development, we advise on structure, collaboration and legal feasibility. This includes anterior agreements, land acquisition, cost recovery, long‑leasehold and building rights structures and environmental and planning procedures. We are involved from the earliest planning stage, taking into account administrative, financial and societal interests.

Construction law

Construction and procurement law regulates the legal aspects of construction projects and the procurement rules applicable to public and semi‑public bodies. This area of law covers contract formation, project execution and dispute resolution. We advise on construction contracts (including Uniform Administrative Conditions for the Execution of Works (‘UAV’) and Uniform Administrative Conditions for Integrated Contracts ‘UAVGC’), construction team arrangements and other forms of collaboration. When disputes arise, we represent clients in negotiations and proceedings before the civil courts, administrative courts and specialised bodies such as the Arbitration Board for the Construction Industry.

Leasing and use of real estate

Our real estate practice also covers matters concerning the leasing and use of real estate. We advise on leasing, subleasing, operation, renovation, defects and the termination of lease agreements. In doing so, we take into account the specific position of investors, public bodies, healthcare and educational institutions and businesses.

Real estate lawyers

Our real estate lawyers and civil‑law notaries work daily on a wide range of real estate projects and transactions. They understand both the private‑law and public‑law landscape and how legal rules, market conditions and stakeholder interests interact.

In the support we provide, we combine legal expertise with insight into the practical realities faced by developers, public authorities, healthcare providers and businesses. This enables us to contribute from the earliest stages, advising on structure, risks and strategic choices that affect the progress and feasibility of a project. We move seamlessly between disciplines such as construction law, planning and environmental law, tenancy law and notarial services, ensuring a coherent approach that aligns with your organisation and real estate strategy.

Our real estate expertise

We advise clients on matters including:

  • Eransactions and financing/refinancing
  • Project and area development
  • Permits under the Environment and Planning Act and and spatial planning issues
  • Construction law and construction contracts
  • Leasing and use of real estate
  • Partnership agreements
  • Leasehold, building rights and other proprietary rights
  • Notarial deeds, transfers of title and security.

Real estate matters by market

While the foundations of real estate law are the same for every organisation, the context differs. We therefore tailor our services to the three markets in which Nysingh operates.

Government and the public/semi-public sector

We advise municipalities and other public and quasi‑public bodies on land allocation, area development, real estate transactions and planning and environmental decision‑making. In doing so, we are mindful of administrative relationships, public interests and transparency requirements such as those arising from the Didam judgment.

Educational accommodation requires specialised expertise in this regard. The regulations are complex and not part of the day‑to‑day practice of schools and municipalities, while the legal and financial risks are significant. We advise and support clients on matters such as funding, decommissioning, sale, leasing and loan‑for‑use arrangements for school buildings. Because we act for both municipalities and educational institutions, we understand the dynamics at play and the interests on both sides of the table.

Healthcare and life sciences

Healthcare real estate is shaped by changing funding structures, the shift toward extramural care and new requirements for buildings and their use. We advise healthcare providers on new construction, redevelopment, transactions, leasing and cooperation structures, with particular attention to governance, funding and continuity of care.

Notices and announcements

For companies and family‑owned businesses, real estate is often a strategic component of both operations and asset structure. We advise on the acquisition, sale, redevelopment and financing of commercial real estate, as well as on the management and restructuring of real estate portfolios within family businesses. In doing so, we take into account continuity, succession and the relationship between business and private assets. While the foundations of real estate law are the same for every organisation, the context differs. We therefore tailor our services to the three markets in which Nysingh operates.
